Those in attendance were: Jennifer Harvey, Madge Darlington, Diane Gierisch, Curtis LaFitte, Rose Wages, and Lance Winchester. I. We heard from Tom Davis of LifeGuard4Hire. 2014 swim lesson registration is now available on the website http://lifeguard4hire.com/. We discussed offering adult swim lessons and a master class in August. We requested the lifeguards enforce the pool rules for our safety and for the enjoyment of everyone at the pool. The lifeguards will continue to do a headcount of people at the pool each hour they are there. II. We will create a sign to put on the ADA chair. Please don’t use this chair as a toy or to jump into the pool. This also applies to the lifeguard stands. III. There was work going on last week to detect a leak in a water line. As soon as it’s found, a repair will be scheduled. IV. If anyone is in the pool area on Mondays or after hours (between 10 pm and 5 am), please report it to Alliance Management 512-328-6100. V. Announcements a. 2014 Schedule: Open swim – with Lifeguards - begins Saturday, May 24 at Noon. Resident Swim, Tuesday – Sunday 5 am – noon; 7:30 pm – 10 pm. No lifeguard supervision. I have a "yard home" but it has a tiny yard so Duncan spends most of his day inside with us besides walks. From the Statesman:If the off-leash dog area at Mabel Davis District Park doesn't happen, perhaps that would be a golden opportunity to request another East Austin location. Patterson is close walking distance, and Bartholomew will be shortly when Berkman connects through. The master plan for Bartholomew does call for a dog park, but I don't know the timeline for implementation. (See and ).

I liked him a lo but he is not available to do the work until November and I am having a baby next month and want to get the work done before the weather turns. Or is this a normal amount of time to wait to have someone start the work? I know we have to have HOA approval but am thinking it doesn't take very long and I want to start using our side yard as soon as possible when the weather gets nice. Thanks, Erica

I had both my front and rear yard completely re-done by John Davis of DavisJane Design. As I have noted to everyone within earshot I LOVE HIS WORK. One of the home inspectors I work with - Glen Davis - told me to avoid the self-clean function on ovens in general. He frequently observes issues after the self-clean. Though he's never mentioned burnt potatoes.

When we purchased our lot it was flat. By the time our home was completed, we had a severe slope which made our yard almost unusable. After almost 2 years of thinking about it we hired John Davis (Davis-Jane Garden Design - 512-693-0923) to turn our vision of our yard into our reality. WELL, TO SAY THAT WE LOVE IT - IS AN UNDERSTATEMENT!!!! John and his crew gave us a gorgeous low-maintenance, turn-key backyard retreat with multiple levels and seating/entertainment areas. We even have six fruit trees (optimist that we are). The drought tolerant, butterfly and bird- attracting indigenous plants and trees combined with the natural stone and crushed granite hard scape provide us with a wonderful oasis. Stop on by, peek over the fence or knock at our door if you want a closer look or more information about the yard or working with John (2049 Antone St.) I've attached a few photos. Daniel

I chose Phil Davis for my tile work and couldn't be more pleased! Phil was reasonably priced, prompt, and the quality of his work was outstanding. He even came up with some ideas for the job that were better than my own! Phil lives in Mueller, and it was so nice to just leave the house with someone trustworthy. For those of you who may not have received the resident email this morning, we wanted to make sure you saw this news. Those of you who follow the activities of ProLogis, the parent company of Catellus Development Group, may be aware of its intent to concentrate focus on its core business, which is to successfully serve as a global leader in distribution facilities. Consistent with this strategy, as you will see in this excerpt from the announcement by ProLogis this morning, the Catellus retail and mixed-use division of ProLogis is being reestablished as a standalone company named Catellus Development with a new partner, TPG Capital, a private investment firm with international interests founded in 1992 and based in Fort Worth. ––––––––––––– DENVER – December 21, 2010 – ProLogis (NYSE: PLD), the leading global provider of distribution facilities, announced today that it has entered into a definitive agreement with affiliates of TPG Capital(TPG) to sell a portfolio of U.S. retail and mixed-use assets and the Catellus name for a total purchase price of approximately $505 million. one-year inspection...necessary?

While I think that a one year inspection is helpful, I think I should also point out that the builder may not fix the problems. In my case, David Weekley refused to fix the major problems that inspectors found.One case was egregious - during the winter months, the second floor of my my home is 6-8 degrees warmer than the first floor. During the first year, Weekley's HVAC contractor Christian came out 3-4 times, but were unable to fix it.My inspector, Glen Davis, did thorough measurements (all documented in pictures) and found that the dampers in the system were not working. Weekley, however, refused to even have their contractor come out to look at the system and Glen's report. What made this really aggravating was that I had spent $$$$ upgrading my HVAC package precisely so this wouldn't occur.So don't assume that the builder will necessarily fix any problems that the inspector finds, but it's still helpful to know what problems exist.Doug

We were very satisfied with our builder and still found the one year inspection valuable. Found a few small items that were overlooked - attic stairs in garage were not fire-rated/insulated, couple of other items. We used Glen Davis of Eagle Inspections. Well worth the money

16 Oct 2010 General Membership Meeting – Mueller Neighborhood Association The meeting was held at the picnic tables outside the pool at Ella Wooten park. Future meetings may be at the hangar or at Ronald McDonald House, depending on the weather. Check mc.com for more information. Vice-pres, Dennis Mick, ran the meeting. – Kerry Fisher reported that our balance is $1659. We haven't distributed grant money and only one application was received. The general membership voted unanimously to extend the application deadline. Motion made by Ashley Fisher and seconded by Corky Hilliard. The new deadline is by unanimous passage of a motion by Ashley and second by Mike McGovern. – Our guest speaker was Griffin Davis from http://www.getaustinmoving.com, the PAC formed to promote passage of this $90million transportation bond package on the November ballot. The project will provide mobility improvements for a variety of modes – cars (53%), bikes, sidewalks and trails. It includes the completion of the hike and bike trail on Lady Bird Lake on the South side of the lake. It's a relatively small bond package that will not result in an tax increase. Included projects are well distributed throughout the City and include several of interest to Mueller – roundabout fix, improvements at IH 35 & 51st St, bike lanes on Manor Road, and preliminary studies for improvements to Airport Blvd. A map of the projects is available on their website. (Detail project listing is available at http://www.cityofaustin.org/news/bond_projects.htm). Those opposed to the proposition generally want either a higher percentage of the funds to go for road improvements, or the improvements split into modal packages so the public can pick and choose what modes to support. After Griffin left, the MNA voted unanimously to endorse the passage of Proposition One, on a motion by Betsy Hilton seconded by Rose Wages. – They've only received about 85 signed contracts. If you want to participate, they need your signed contract. Please turn them in. They are a little behind schedule for installing the monitoring equipment. There may be a happy hour on Wednesday – watch mc.com for info. – Kat Malcom reported on several recent events: - Neighborhood Night Out (NNO) – The event was very successful and those present liked the format better this year. Kat heard about 17 different block parties that were planned. Next year Mueller will be the focal point for the City with respect to East Austin and some events will be held at the hangar. - Boomer group (for baby boomers) held a successful progressive dinner - Mueller Gay and Lesbian Resident Potluck planned for Oct. 23. About 35 people have signed up so far. - Another 'networking' happy hour is planned for Nov. 18 – watch mc.com for details. - Some folks talking about planning Thanksgiving gatherings for neighbors without families in town. – Ashley Fisher reported on the last PIAC meeting. PIAC will be sending a letter to the City approving the process used by Austin Energy in development of the substation near Mueller. Hello,Background :I've spoken with the previous chief residential inspector and one of the managers at Austin energy and neither of them were aware of the situation and we are all in agreement the flipping of the evaporators is going to be a nightmare for servicing, and could easily be construed as noncompliant with the access sections of the code. Many of the units don't have correct service platform depth in the first place and that is not disputable. We are also in agreement that the access issues are not the fault of the HVAC contractor but of the design professionals in not providing adequate vertical height for the HVAC contractors to properly locate their equipment on many of the homes. Please bear in mind this is not an issue on all homes nor all builders. It is truly dependent on the roof line and where the equipment was placed.I also placed a call to one of the managers at CASA and we had a very informative and cordial phone call. Mr. Gurino ( I hope I spelled it correctly ) explained that the reversal on the evaporator compartment was due to an issue on specific Carrier units that were slinging excessive amounts of water towards the supply plenum which would saturate them and potentially subject them to mold. They contacted the manufacturer and they were instructed to reverse the units and told the units were designed to be reversed if need be and this would prevent the slinging of the water. Apparently, this particular fix around has been working but as already discussed, it is my opinion they're going to be extremely difficult to service. CASA disagrees with me and stated that their policy would be that if any servicing needed to be done while under warranty or after warranty, that they would remove the evaporator compartment entirely regardless of positioning. The supervisor told me the approximate cost would be in the $350 range ( which does not include any parts etc that may be needed for repair ). I've also spoken with numerous AC contractors, other credentialed inspectors, a few mechanical engineers and we are all in agreement ( with only minor variances ) there other questions that needed to be answered which include (1) why were the evaporators slinging water in the first place and why do models prior to and after that particular model not have the problem (2) why were the evaporator's not switched out (3) why were the evaporators not provided with a sling shield that are used by some other manufacturers. In addition to these unanswered questions, the consensus on the HVAC contractor side was of significant disagreement with the CASA protocol for tearing out the entire compartment to simply do a visual service evaluation into the coil compartment to check for icing or rusting. Most HVAC contractors also stated due to the extreme low height and access conditions and difficulties in reattaching all of the piping and ducting seals that their tear out and re-installation for labor alone could easily be double the fees quoted by CASA.So we are clear, the intent of this entire thread is not to alarm nor point any specific fingers. The intent was to educate not only myself but the homeowners in the community. There has been a tremendous amount of misinformation with this topic, other AC issues, property set back and fire protection issues including attic ventilation issues that continue to be propagated. It's easier in the end for me to reach the community with information this way rather than having to explain one of these situations every time I go out. In condensing this ( pardon the pun ) , I want to reiterate Mr. Gurino from CASA has assured me that they had the blessing of Carrier and assuming that to be the case, we as inspectors have no issue with it so long as the basic accessibility requirements of the codes are met, which in site-specific cases are not being met. Mr. Gurino also assured me that the reversal would have no impact on system performance and that they stand behind their work and warranty. What net effect the evaporator coil compartment reversals will have from here on out to the affected homeowners will only be determined when the warrantees run out and third-party HVAC contractors begin performing repairs in the community.It remains my professional opinion that these specific systems will be extremely challenging and costly to work on and they possibly could have been avoided had other options been explored and/or implemented to the fullest extent. Clarification :I received a Pm asking if this was directed at any specific builder and the answer is NO. It was placed under the Meritage forum only because that was the most recent post of AC issues and I do not know how to create a new forum.So we are clear, In my experience this has occurred with more than one builder and is not specific to any one builder. The only thing in common is the answer builders have given clients. If the HVAC contractor does return the call and explain their theory, I will be happy to state their company name and their response regarding this specific example home.Otherwise, it is my policy not to implicate any particular builder unless there is irrefutable proof as was the case with the non-compliant soffit venting some time back. Hello folks, This is an issue that some of you are aware of but I suspect many of you are not. I recently received an e-mail back from a client with a reversed AC evaporator unit and the preliminary feedback is that the warranty rep appears to have told my client this was done purposefully by the HVAC contractor for reasons that make absolutely no sense other than to avoid having to get up in the small attic areas and tear out the equipment and reinstall it as it should have been originally. I placed a call this morning to the HVAC contractor supervisor requesting him to call me back and explain this logic and have yet to receive any response. After I speak with him ( assuming he calls me back ) I will be happy to update this post. It's interesting to note that as they say it is done purposeful, you'll also find in some of the floor plans where there are two systems , one of the units are reversed and the other is not which defeats any logic they offer. This is not rocket science. As a Mechanical Code Official ( certified as a residential and commercial HVAC inspector and HVAC plans examiner ) there is nothing that supports installing the equipment reversed in a situation where the access cannot be provided. The issue is specifically about the lack of being able to access the control side of the equipment for basic servicing or evaluation of electrical malfunctions. In contrast, the residential electrical and mechanical code specifically require a support platform access to be provided in front of the control side of the equipment. The builders respond " it was approved by the city inspector and therefore must be code compliant". The reality is the city inspector never entered the attic and never recognized the situation. Nonetheless, it remains non-compliant with the code irrespective of the city signing off. When the two-year warranties begin to run out and the homeowners begin to go to third-party HVAC contractors for basic repairs, these issues are going to come home to roost in a very unpleasant way when the third-party contractors inform you they are going to have to completely disconnect all of the equipment and ducting plenums in order to simply check basic things like electrical connections, evaporator coil, fan speed settings and basic things that are located in that compartment that can never be accessed. The repair bills will be extremely expensive and all due to the fact that the HVAC contractor did not install the equipment compliant with the residential code. I would urge each of the homeowners to take a look at their equipment to see if they are faced with a similar situation. Review the attached photo and you will see an example photo showing the primary PVC lines and refrigerant line sets entering the front of the evaporator compartment ( correct install ). If you cannot see this on the side of your equipment that faces the plywood service platform, you likely have a reversed unit. Please feel free to call me and I will guide you verbally in order to avoid the expense of having me come out. If this is something that affects you, I would strongly urge you to fight tooth and nail even to the extent of contacting the residential inspection department at the City of Austin. In my professional opinion, the primary failure rests entirely at their feet followed closely by the HVAC contractor not following code compliance requirements. Normally I would have given you a direct contact name for the chief inspector but at this time the city is currently interviewing for a new chief. I don't know who is assuming that temporary role. I will also warn you the city may likely be the first to disclaim any liability and defer this right back to the builder. This situation will not get corrected until enough homeowner's are educated and stand united in getting these issues corrected as they should be. I simply don’t agree. For families with kids, you have to take into account things like child care and health care. The example in my original response is not unreasonable. It’s typical. And I think expecting that family to spend 208K on a house is not a good idea. And expecting them to be able to save up 40K for a down payment is probably not realistic.Sure you can come up with a huge number for the amount of money saved living closer in if you are talking about driving a hummer in from cedar park every day, but a lot of people aren’t doing that – they’re driving civics and other cars in from Davis and Manchaca or something along those lines. They don’t have this magic $500 they can suddenly make appear.

Good morning, I am curious as to the issues of concern with D.V. I have gone to D.V. since sixth grade and graduated at the old DV high School. Also my 12 year old son attends DV middle school and will now be attending the new Dailey MS. My 6 year old daughter will be going to Hornsby. Over the years I have raised my concerns about the lack of resources provided by the district towards development programs. In fact several years back I was able to obtain all of the paid salaries from top administrators all the way down to assistant coaches. The reason for this was that they were unwilling to spend a little bit of money to insure every elementary school had an adequate number of books. Another year they could not provide a Gifted and Talented program for my son and at least 20 other kids in the school. Another public information request was for school budgets and allocations. The facts show that there are overpaid administrators and mismanaged funds that lead to Budget shortfalls. Another issue is that Del Valle prides itself on its athletic achievements yet the after school programs offered to students are very expensive to most people. There are thousands of dollars either wasted or stolen by the administrators of these basketball leagues, football camps, volleyball seminars, etc. Some administrators magically bought new cars after the dues were paid. The schools should provide the gyms and fields at a very low cost to bring down the required fees by parents. All money profited should go mostly towards expanding the programs and also lowering the cost as much as possible, not to any one persons pockets. I have seen over the years that a lot of talent both mentally and physically has been wasted in the DV district due to a lack in development. Our school district needs to stop the skimming of funds and allow this much needed money to go to the kids programs. If the school board or administrators have excuses then we should call them out on it and request any information that we need. it is a fun hobby for me to request public information requests so please let me know what information you could use and I will do my best to get it. Hi, I grew up two blocks from Village Homes and it is "similar" to Mueller but not quite. There was never a plan for a Town Center, but it was and still is a thriving community. The majority of the homes are solar and have been since the early 70s, composting was the norm, and the gardens are STILL beautiful. They did get a junior high school which I attended! [:smile:]
