The park is a public space. As is the parking lot. There is absolutely nothing in the municipal code that allows the towing. The only thing they could do to stay within code is to have the signs put up by the city or state. Regardless of your opinion on the matter, what they're doing is illegal. If they want to deal with it, pass an ordinance and change the code.

Except as provided in Subsections (B) and (C), a person may park a motor vehicle in a park, playground, or nature preserve owned, operated or maintained by the city only:

(1)

in a designated parking area;

(2)

within 12 feet of the edge of a roadway where parking is authorized; or

(3)

at the direction of a police officer or park police officer.

(B)

Except as necessary for loading or unloading freight, construction maintenance, or repair of a park or playground, a person may not park a motor vehicle in a park on a hike and bike trail.

(C)

A person may not park a motor vehicle in a place designated as "reserved for patrons" at a recreation facility, museum, nature preserve, or golf course unless the motor vehicle has been issued a parking permit by the director.

I am on the POA Landscape Committee and wanted to point out that while Lake Park is open to the public, it is not property owned and operated by the city of Austin. It is POA Property.

The streets on the other hand were conveyed to the city and accepted into their jurisdiction following construction. Parking within the streets around Mueller are public city streets and therefore under city rules. There has been a work group of Mueller neighbors and the city developing plans on how to manage the street parking within and around the Town Center. Others on that committee could better address their discussion. I only know what we have discussed in the Landscape Committee.

Lake Park is now and will be in the future owned by the Mueller POA. The POA would have jurisdiction over the park and associated parking lots. Our POA is responsible for the towing of the cars not the Thinkery nor the COA.

We have run into COA enforcement issues on a number of issues/disturbances at both Lake Park and Ella Wooten because of this distinction. We have had similar issues with late night parties, activities around the basketball court etc.

For instance our POA has a 10pm curfew on Ella Wooten and Lake Park similar to the COA rules. City police cannot enforce that rule. They can and from my personal experience will only ask the persons to leave and if they fail to do so then arrest them for trespass but not the curfew. If is were a city owned park they could do both. I remember Sargent Jones explaining this at at least one of the MNA Meetings in the recent past.

I'm so happy to see that the majority of our community understands the critical importance of rules.
Like my father, Gregor, used to always say, "Obey, monitor, and enforce! Never forget enforce!" He would have approved of the prevailing sentiment held by most of the contributors to this discussion.
