I shake my head every time I think about it, "... The required earnest money amount is $10,000." That is so much BS. $2,600 - $3,000 would be a more reasonable amount, with it being potentially non-refundable. If you Google "earnest money" the standard is about 1.0% at best. David Weekley Homes should allow for the earnest money to cover ALL buyer's fees and costs (including any upgrades).

I wonder what the Attorney General or the City of Austin , or any consumer rights group has to say about this outrageous requirement. Everyone is so worried about the "affordable housing" group. They won't be able to fit a family of four in a David Weekley home low-end $200K home anyway.

What about the rest of us? What happened to our “buyer’s rights”?

Another issue-- why does David Weekley Homes have the most negative comments on this community site?

That’s a very RED flag, and an indication that the Attorney General or the City of Austin , or any consumer rights group should be watching David Weekley Homes very closely.

I recently signed a contract. I begged for flexibility in the $10K earnest money and there are no exceptions. The only alternative to all earnest money at signing is an initial payment of $5K followed by a second $5K payment one month later.

I think we all agree that the $10,000 earnest money is at best mind-boggling, but it is not 100% non-refundable after 48 hours. Portions of it will be refundable depending on the point when you pull out. This can be outlined by David Weekley.
This money also goes towards the first $10,000 of your upgrades. Most builders will make you pay 50-100% of upgrades (non-refundable) up front anyway.
The earnest money will be returned to you before closing so you can put it towards your down payment.

I received the email from DW about the earnest money, it was dated 8/14, and it clearly states that you'll get the money credited back to you at closing. While $10k earnest money is a tough pill to swallow, I hardly see how this has become a "living hell" as was quoted. That's a bit melodramatic.

Here's the full text from the email:

"Dear Mueller Pioneer,

Congratulations again on being part of the Mueller Pioneer Program. We are excited to report that sales are going very well out here at our Mueller sales office and that construction will begin on the first blocks of Mueller Yard and Row homes in September.

Now that we are writing Purchase Agreements and making our way through the Pioneer Lists, we want to inform you of a few items you will need in order to be prepared when you come in for your Purchase Agreement appointment.

Each person whose name will be on the Purchase Agreement needs to bring their current driver’s license (ex: you and your spouse).
If you are using a Realtor, they must accompany you to your first appointment in order to receive credit for the sale.

The required earnest money amount is $10,000. This will be credited back to you at closing. We can accept a personal check or money order. We are not able to accept credit cards.
All parties that will be on the Purchase Agreement need to be present at your first appointment.

We encourage you to contact us with any questions you may have about our sales or construction processes. We want you to be comfortable with this decision…it’s a BIG one! You are also welcome to schedule an appointment with us to look more closely at a particular floorplan or for us to answer any questions you may have prior to writing a Purchase Agreement.

Thank you again for your patience during this process and for choosing David Weekley Homes to be your Mueller builder. We look forward to working with you.

I think many of us are upset because we never envisioned the project going this way. Some of us were on board well before this builder got involved, and now the only thing standing between us and Mueller is this builder. I don't know how DW got approved for this project, but it was not at all what I expected. We were shocked by the earnest money, but willing to pay it. We wanted a certain lot and were willing to pay the premium. One thing after another we were shocked but then always came back to wanting to live in Mueller. The last straw for us was the interior. We were ok picking from their exterior palette, but to not budge on the interior was insane to us. How could a builder building in a supposedly urban area not recognize concrete flooring as a final product in 2007?!?! We understand that not everyone would want that, but to not even have it as an option is incomprehensible to us. Again, this is 2007, not 1994!! Has anyone received their issue of Austin Monthly Home? There's a pretty slick ad in there for Mueller and it doesn't look anything like what I saw in the DW showroom.

So did you end up not buying? I can tell how much interest you had in the community from all your post, which really makes it unfortunate if you were not able to buy. Have you thought about switching over to Standard Pacific? They have about 20 units available that may meet your needs.

We considered other builders, but Standard Pacific no longer has plans available in our price range.
